Frequently Asked Questions

  • How do I dispute a traffic fine?

If you were issued a fixed penalty notice by an individual police officer, then you can submit an online review request via the NSW Police Force’s website or send an email directly to the State Traffic Authority. You will need to provide detailed information regarding why you believe the violation should be reversed or reduced. In some cases, if sufficient grounds exist, such as exceptional circumstances or lack of evidence provided by the arresting officer, the fine may be dropped. If the original fine cannot be dropped, but your appeal is successful, the amount of the fine may be reduced. Of course, you can also dispute a traffic fine in court by seeking legal counsel.

  • Can a solicitor help prevent my car licence from being suspended?

Depending on the circumstances of your case and individual situation, a solicitor may be able to help you find a suitable legal solution that results in you retaining your licence. Your lawyer can also advise you on any potential repercussions that may arise from suspension and how to proceed in order to avoid such an outcome. If you receive notice of suspension or disqualification from the Roads and Maritime Services (RMS) then it is highly recommended that you seek legal advice immediately.

  • What are the different classes of drunk driving?

In New South Wales, there are three classes of drunk driving offences: Low Range PCA, Mid-Range PCA and High Range PCA. Low Range PCA is the most common type of drink driving offence in NSW and it occurs when a person has a Blood Alcohol Concentration (BAC) of between 0.05 and 0.08%. Mid-Range PCA applies when a driver’s BAC is between 0.08% and 0.15%. High Range PCA applies when a driver’s BAC is above 0.15%. Different penalties apply for each class, which your solicitor will discuss in detail with you.

Offences that Put Your Licence at Risk

In New South Wales, a range of traffic offences can result in the loss of your licence. These include driving under the influence of alcohol or drugs, excessive speeding—any speed over 45km per hour over the speed limit will generally trigger an automatic loss of licence when detected by police—and dangerous and negligent driving. If you are convicted of one offence or multiple offences within a three year period, you may also face loss of licence.

Additionally, if you fail to pay traffic fines in full before their due date, have too many demerit points on your licence or become involved in street racing activities, then you could be disqualified from holding a driver’s licence. Any combination of these events that lead to serious injury or death is likely to be met with harsher penalties. Loss of licence for traffic offences can also have serious implications for your insurance premiums.

Our Hunter Valley solicitors will help you understand the repercussions your facing as a result of a traffic offence, as well as strive to secure the best outcome that allows you to retain your licence. Get in touch today to discover how we can address your unique concerns.
